PRIVACY NOTICE

Under the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (the “LFPDPP”) and applicable regulations, Becquerel Capital, Sociedad Anónima Promotora de Inversión de Capital Variable, (“Becquerel” and/or the ” Responsible”), with address at Coahuila 52-2, Roma Norte, CP 06700, Mexico City, Del. Cuauhtémoc, expressly informs you of the following:

 

Personal data subject to treatment by Becquerel.

To carry out the purposes described in this notice, we will collect for your treatment, the following personal data (the “Personal Data”) of which you are the owner (the “Owner” and/or “You”): (i) Identification data, (ii) Contact data, (iii) Academic data, (iv) if applicable, migratory data, (v) verification of data through social networks, (vi) property and/or financial data, ( vii) income and expenses through access to your Tax Administration Service account and/or bank accounts, (viii) reason for the requested credit, and (ix) type of business.

The Sensitive Data that is collected from the Holder, will be obtained directly by Becquerel or through the Electronic and Authentication Means that Becquerel makes available to the Holder, and that the latter must expressly accept.

The express consent of the Owner for the processing of Personal Data will be obtained through our website www.becquerelcapital.com, or by any other electronic, telephone, video, or other technology (the “Electronic Means”) and in its case, through agents, promoters, commission agents, suppliers or business partners; the foregoing to be able to provide you with the services and/or products offered by Becquerel (the “Services”) and to fulfill the purposes indicated in this Privacy Notice.

Becquerel informs the Holder that regarding the personal data of other people that the Holder provides to Becquerel, such as joint and several obligors, guarantors, guarantees, suppliers, beneficiaries and any other legal figure related to the Services, the Holder undertakes to inform those people about the treatment of their personal data and the content of this Privacy Notice.

 

Necessary Purposes

The Personal Data and, where appropriate, the Sensitive Data that Becquerel collects are used to be able to fulfill the following purposes:

 

a) Compliance with the contractual relationship derived from the request and/or contracting of the Services.

b) Verify, confirm and validate the identity of the Holder, as well as the veracity of the information provided as their own, references, joint and several obligors, guarantees, as applicable in accordance with the Service contracted with Becquerel.

c) Verify the autograph signatures, in the records managed by the National Electoral Institute or any other authority that issues official documents in the United Mexican States, include the result of the verification in the identification file of the Holder and safeguard the information for hiring of the Services.

d) Manage, operate and monitor the Services that you request or contract with Becquerel.

e) Carry out the analysis of the information provided by the Holder, in order to determine in accordance with current legal provisions, the level of risk, feasibility of payment, transactional profile, and any other evaluation that is required by the regulations for the provision of Services.

f) Formalize the contractual relationship between Becquere and the Holder.

g) Include them in our database, integrate files, directly or through a third party.

h) Process the requests you make through our Electronic Means.

i) Create your profile as a user on our platform.

j) Verification and investigation of creditworthiness.

k) Consult and carry out credit investigations before credit information companies that it deems appropriate.

l) Offer an extension or improvement of the contracted Services.

m) Inform about Service updates.

n) Carry out commercial intelligence, carry out market research, give visibility to your activity in our Electronic Means, monitor the quality of our Electronic Means, evaluate and improve our Electronic Means.

o) Send communications through our Electronic Means related to the contracted Services.

 

Non-necessary purposes

a) Sending offers, promotions, marketing or special events that may be of interest to the Holder.

b) Submission of articles on topics related to financial education.

c) Send Becquerel’s newsletter and offers, as well as benefits and services offered by commercial partners.

d) Send the Holder’s contact information to business partners and their clients in order to put them in contact with the Holder regarding the products and services that the latter offers.


The Owner of the Personal Data may refuse the processing of their Personal Data for unnecessary purposes, by sending an email to the address contacto@becquerelcapital.com; in the understanding that, in case of not receiving the corresponding request, the use of your information for all the aforementioned purposes will be understood as consented.

 

Transfer of Personal Data

Becquerel will share your Personal Data with: (i) its parent companies, subsidiaries or affiliates under the common control of Becquerel, as well as our parent company or any company of our corporate group that operates under the same internal processes and policies, (ii) with competent authorities, if requested, in terms of the applicable legislation, (iii) companies or companies in charge of fraud investigations and collection of payments, (iv) with other companies in case of being acquired, merged or any other operation similar by that company, (v) third parties including financial entities, for transfer or discount of credit portfolio, endorsement or any other form of negotiation of the credit portfolio, (vi) commercial partners with whom they have entered into contracts for the commercialization of products and/or services for the benefit of the Holder, and (vii) in any other of the cases established in articles 10 and 37 of the LFPDPP.

 

Exercise of rights of Access, Rectification, Cancellation and Opposition (ARCO) and revocation of consent

The Owner of the Personal Data has the right to access, rectify, cancel, or oppose the processing of their Personal Data held by Becquerel. The exercise of this right must be made in writing, said request must be submitted to the address of Becquerel addressed, the person in charge of processing requests related to personal data and promoting their protection by interior of Becquerel will process the request; or by email contacto@becquerelcapital.com; must accompany the following information and documentation:

 

  • Name and address or other means to communicate the response to your request, as well as the documents that prove your identity or, where appropriate, legal representation.

  • Any other element or document that facilitates the location of Personal Data.

  • The request must be signed at the end of the document and initialed at the bottom of each page.

  • The clear and precise description of the Personal Data with respect to which ARCO Rights are sought to be exercised, as well as the right or rights to be exercised, which may be done in the text of the email or in a scanned attached document and duly signed at the end of it and initialed at the bottom of each of the pages

 

Once the request has been submitted in the aforementioned terms, Becquerel will issue the decision adopted within a period not exceeding 20 (twenty) days from its receipt. If the request is appropriate, it will be made effective within 15 (fifteen) business days following the date on which the Responsible communicates the response. In the event that the information provided in your request is erroneous or insufficient, or the necessary documents are not attached to prove your identity or the corresponding legal representation, the Responsible, within 5 (five) business days following receipt of your request, will require the correction of the deficiencies to be able to process it. In these cases, you will have 10 (ten) business days to attend to the request for correction, counted from the day after you received it. The corresponding request will be deemed not submitted if you do not respond within said period.

The Holder will be responsible for keeping their Personal Data in possession of the Responsible updated. Due to the foregoing, the Holder guarantees and is responsible, in any case, for the veracity, accuracy, validity and authenticity of the Personal Data provided, and undertakes to keep them duly updated, communicating any changes to the Responsible.

If the request to exercise ARCO Rights is about the exercise of the right of access, Becquerel will make the information or Personal Data available to you through simple copies and/or electronic documents. The Owner of the Personal Data may revoke the consent for the treatment of the same in accordance with the aforementioned procedure.

 

Becquerel, may deny the exercise of ARCO Rights in the cases permitted by the LPDPPP and its regulations

The Holder may revoke his consent for the processing of his Personal Data, without retroactive effect, in all those cases in which said revocation does not imply the impossibility of fulfilling obligations derived from a current legal relationship between the Holder and the Responsible. The procedure for the revocation of consent, where appropriate, will be the same as that established in the immediately preceding section for the exercise of ARCO rights.

 

Means to Limit the Use or Disclosure of your Personal Data

The Owner of the Personal Data may limit the use or disclosure thereof in accordance with the procedure set forth in the section “Exercise of ARCO Rights and revocation of consent”.

 

Use of Cookies, Web Beacons and Other Similar Technologies

You are informed that Becquerel uses remote or local electronic communication mechanisms, or other technology that allow us to collect Personal Data related to your activity in the Electronic Media and Services.

A cookie is a piece of information that our web server can send to your computer when you visit our Electronic Media. A cookie helps us to recognize your user when you revisit the Electronic Media. You can delete, block or receive a warning about cookies in the most common Internet browsers. If you want to do this, you should refer to your browser’s instructions or help screen to learn more. However, cookies will allow you to take advantage of the most beneficial features that our Electronic Media offers you. The Electronic Media may include links to websites of third parties unrelated to the Responsible, for which the latter does not assume any ownership, obligation or responsibility.

 

Consent

It will be understood that by using our Electronic Means and/or contracting the Services that we offer for the purposes set forth herein, you expressly acknowledge and accept this Notice, for which said consent grants us the power to proceed with the treatment of the same in the manner in which indicated in this Notice.
